US visa for startups legislation delayed by Trump
While there are concerns about the US visa for startups there are still opportunities to start up in the US. Two US visa categories that are worth considering are the E2 Treaty Investor Visa scheme and L1 visa scheme. There is no quota for these particular visa categories and they can be used both by investors and employees.
The E2 visa allows nationals of certain Countries to start a new business in the US. In many cases the investment requirement does not need to be that enormous. Unfortunately, the E2 visa and E1 visa category is not available for nationals of India and China (apart from dependents). For businesses that have an existing presence outside the US there is the L1 visa category that can be used both by business owners and employees. Even under Trump there are good opportunities to enter the US.

It may be a long time before we see major changes to the UK visa system. It seems that a no deal Brexit is increasingly unlikely. MPs will probably prefer to delay Brexit. Even a number of pro Brexit MPs are in favour of delaying Brexit. There is also likely to be a lengthy transition period. So the Tier 2 Sponsor Licence and Tier 2 visa system could be with us for some time.
Following the latest Tier 2 visa allocation of restricted certificates of sponsorship meeting, the number of Certificates of Sponsorship (CoS) available for March 2019 stands at 1,921, according to UK Visas and Immigration data. The department published its December report, citing that its figures were correct as of 20 February, 2019. It seems that it continues to be the case that as long as UK employers meet the other requirements they are likely to be able to obtain restricted CoSs to employ overseas nationals resident outside the UK.
US E2 visa available through company mergers and acquisitions
The US E2 visa is potentially available to key workers and new hires as a result of company mergers and acquisitions. According to the National Law Review - an online resource that monitors legal trends – changes to corporate structure, as a result of a company merger or acquisition, can have huge ramifications for key workers and new employees.
In particular, the US immigration status of keyworkers and new hires could be affected. However, if a US business is acquired or formed as the result of a merger, and the business is majority-owned by a non-US based business or foreign national from an E2 country, it’s possible that the US E2 visa could be available to keyworkers and new hires.
Brexit UK Tier 2 visa numbers by Migration Watch wrong
A press release published by Migration Watch on the morning of February 13 claimed that post-Brexit, UK visa proposals could lead to record levels of immigration. However, just hours later, the so-called independent, non-political think-tank issued a second press release withdrawing the claim.

Migration Watch has an anti-immigration agenda. They are in reality biased and frequently put out highly misleading information on UK visas. It is not surprising that Migration Watch has made yet another mistake with the figures. Somewhat controversially David Cameron when Prime Minister made the Chairman of Migration Watch, now called Lord Green of Deddington, a peer in October 2014. People have commented that this was a cynical attempt to attract votes.
