US B-1 in lieu of H-1B Visa Update

This is to send highly skilled graduate level staff over to the US to work for short periods of time. It is possible to gain entry without a degree level qualification as long as you have a good level of experience equivalent to at least a degree, and the job in the US is a highly skilled job. Usually the visa is granted for up to a year.  It is a faster alternative to the L1 visa and H1B visa.

Like in many other Western Countries the visa options for entry to the US are somewhat limited.  Even with a high level job offer it is not easy to gain an US non-immigrant visa or in some cases an immigrant visa.  The main options for most people are the L1 visa, E2 visa, H1B visa or B1 in lieu of H1B visa.

US E1 Visa and E2 Visa Video

The US E2 visa and in some cases the E1 visa may be the only option in many cases.  However, it is only available to certain nationalities.  For example Indians and Chinese nationals cannot apply unless applying as a spouse or dependent.

Tier 2 Sponsor Licence Video

The Tier 2 Sponsor Licence and Tier 2 visa scheme is the main entry route for skilled workers.  The Tier 1 General visa has not existed for some years.  Initially the employer needs a Tier 2 sponsor licence which is quite a difficult, expensive and complicated process.

Tier 2 Sponsor Licence Audit Guide

Once the employer has a Tier 2 sponsor licence It is not that easy to keep it.   You need to have excellent record keeping and be prepared for site visits by the Home Office.  This can be a time consuming process.  We provide details on how to prepare for a Home Office audit.
