Tier 2 general rules for migrants

General rules applicable to all applicants wanting to travel to the UK under Tier 2

  • An applicant qualifying for entry under Tier 2 may still be refused on other grounds (such as previous immigration history)
  • All supporting documents must be originals rather than copies
  • Any document which is not in English or Welsh must be accompanied by a fully certified translation by a professional translator
  • Any incomplete application or an application which does not include the required documents will be refused
  • Entry clearance must be arranged prior to arrival in the UK
  • Application for entry clearance must be accompanied by a valid Certificate of Sponsorship reference number
  • Entry to the UK is permitted up to 14 days before the employment start date recorded on the Certificate of Sponsorship
  • The applicant must be a minimum of 16 years old at the time the appliacation is decided
  • If the Sponsor is a limited company then the applicant must not own more than 10% of its shares
  • The applicant is not allowed any recourse to public funds whilst in the UK
  • The applicant must register with the UK Police if this is required (Generally this only applies to nationals of certain countries)
  • The applicant must work for his or her sponsor in the job detailed on the Certificate of Sponsorship
  • The applicant may take supplementary work and engage in voluntary work
