If Brexit does eventually happen it seems that the UK visa system may not be ready.  The Tier 2 Sponsor Licence and Tier 2 visa system remain unchanged.  The confusing, complicated, unjust and unfair system causes numerous problems.  Companies and individuals have suffered because the Tier 2 visa system allows UK Visa and Immigration to revoke Tier 2 Sponsor Licences almost at will. 

If the Home Office really wishes to they can find a way to revoke Sponsor Licences.  Judges know that the Law is incredibly biased against the Tier 2 sponsor employer and the Tier 2 visa employee, so are more likely to find against the employer and employee in Court.  As there is no proper right of appeal Home Office officials have less incentive to behave in a just and fair way.  Is this really a Western democratic Country or a “Police State” we wonder?  The system is also not suitable to enable Companies to bring in more people after Brexit.  Presumably, a simpler and cheaper system is needed.

Following the latest Tier 2 visa allocation of restricted certificates of sponsorship meeting, 530 Certificates of Sponsorship (CoS) went unused from the 2018 – 2019 annual limit, according to UK Visas and Immigration data. The department published its March report, citing that its figures were correct as of 28 March, 2019.

An employer with a Tier 2 Sponsorship Licence needs to apply for Certificates of Sponsorship for immigrants they wish to employ. Under the current UK immigration system, unused Tier 2 restricted CoS to employ people who are currently based outside the UK, can be reclaimed after three months. This increases the availability of restricted CoS.

The number of certificates reclaimed as not used within three months for the month of March totalled 246.

The March, Tier 2 Certificate of Sponsorship allocation meeting took place on 11 March, 2019. All valid applications lodged by 5 March were successful, provided they scored the minimum 21 points needed for an application to be approved.

The next UK Visas and Immigration allocation meeting will take place on 11 April and will indicate the number of Tier 2 CoS that will be available for the month of May, 2019.
