Tier 2 Restricted CoS Points are down to 21 points, so obtaining a restricted CoS to employ someone based outside the UK on a Tier 2 Visa is the easiest it has been for about nine months. It may be an idea to apply soon in case the points requirements increase in future.
Tier 2 visa and other UK Visa rule changes from 6 July 2018
UK Visa and Immigration made several changes to UK immigration rules that came into effect on 6 July, 2018. Several immigration categories have been affected, but headline changes to Tier 2 visa rules have undoubtedly been recognised as the most significant.
After in many cases having to wait for many months to gain an UK visa, in August 2018 there was good news for prospective tier 2 visa migrants based outside the UK, and their employers with a tier 2 sponsor licence. The points requirement for a restricted CoS in August went down to 21 points from 41 points in July and a high of 60 points in June. You need a Restricted CoS to employ tier 2 visa applicants who need to apply for a UK visa from outside the UK. For about seven or eight months the salary requirement for many applications was so high, that employers simply could not afford to pay the high salary required to gain enough points for a tier 2 visa.
John McCain US Immigration Reformer dies at 81 years of age
Senator John McCain US immigration reformer, five times elected to the US Senate and Vietnam war hero died on 25 August 2018 of brain cancer. He had been ill for over a year.
McCain and co-author Mark Salter had the following to say about immigration reform:
"We failed twice, and then once more after Ted had passed away, despite big majorities in both houses of Congress in favor of it,"…. "I'd like to say I'll try again. But that is not up to me anymore. That's a harder disappointment than other defeats have been because first, it's something that most Americans want, and most members of Congress know is the right thing to do.
Tier 1 exceptional talent visa available to fashion designers
The tier 1 exceptional talent visa category is worth considering. It is difficult to obtain. However, for a certain number of people who are talented and may be able to achieve great things it is worth looking at. You do not need a job to apply under this visa category and you can work for anyone. Like the discontinued tier 1 general visa category it offers much more freedom for the migrant than the tier 2 visa category. It is also not necessary for the employer to have a tier 2 sponsor licence to employ someone under this UK visa category. It should be noted that under this category there is also tier 1 exceptional promise visa which may be easier to come under. If the case is well presented you may very well be able to succeed under this UK visa category.
US visa enforcement scraps extreme automated vetting plan
As previously announced US visa applicants and holders will not be subjected to controversial, high-tech plans to monitor their social media activity and gauge whether they would ‘positively contribute to society’, US Immigration and Customs Enforcement (ICE) has announced. The agency has instead indicated that people not sottware systems will continue to oversee the vetting process.
It is probably good news that the automatic system for “extreme vetting” will no longer be used. The current extreme vetting system has caused unfairness and hardship to many people. There can be lengthy delays in issuing visas and people have been refused US visas for no good reason. If the new system had been put in place we could have ended up in an even worse situation than before.
