Tier 2 Visa Certificate of Sponsorship December Availability
Following the latest Tier 2 visa allocation of restricted certificates of sponsorship meeting, the number of Certificates of Sponsorship (CoS) available for December 2018 stands at 2,213, according to UK Visas and Immigration data. The department published its November report, citing that its figures were correct as of 19 November, 2018.
The good news is that for about four months since August 2018 there has not been a shortage of restricted Certificates of Sponsorship. From December 2017 to about June 2018 salary rates to obtain a restricted Certificate of Sponsorship were so high that many employers with a Tier 2 sponsor licence simply could not afford it. Many doctors and nurses badly needed by the NHS and others were unable to gain entry to the UK during this time. However, the Tier 2 visa system remains overly complicated and bureaucratic.
US H1B visa and L1 visa denials increase due to Trump policy
Shortly after Donald Trump signed the ‘Buy American, Hire American’ presidential executive order on April 18, 2018, United States Citizenship and Immigration Services (USCIS) began to increase the number of Requests for Evidence (RFEs) and denials for H1B visa petitions, according to new evidence released by the National Foundation for American Policy (NFAP). There is also a similar situation for L1 visa petitions including both L1A visa and L1B visa applications.
US visa difficulties are surely affecting economic growth and job creation in the United States. To be able to work in the US was in many cases already very difficult under President Obama. It is even worse under President Trump. Much of the time the only visa categories available are the L1 visa and possibly the H1B visa. In reality if you wish to employ someone currently based outside the US on an H-1B visa the chances of success are low. In recent years, in most cases, the only time that you can apply for an H1B visa to employ someone is in the beginning of April each year to start work in October of the same year. There is a lottery for the available H1B visas available. The alternative E2 visa and E1 visa categories are not available for Indian and Chinese nationals.
Tier 2 Sponsor Licence UK Visa decision upheld by High Court
A recent Home Office decision to revoke a company’s Tier 2 Sponsorship Licence for apparent incorrect use of four Tier 2 Certificates of Sponsorship (CoS) has been upheld by the High Court. Liral Veget Training and Recruitment Ltd lost its licence after the Home Office said that the job descriptions and skill levels of four migrant workers on Tier 2 visas they were sponsoring were not at a high enough level.
We have said this before. The UK Tier 2 Sponsor Licence and Tier 2 visa system is unjust and unfair. The laws are biased against employers and migrants under the Tier 2 visa scheme. The likelihood of winning in Court proceedings is not high. There is no proper right of appeal against revocation of a Tier 2 sponsor licence anyway. You can only make an application for Judicial Review. Even if you win the Home Office may decide to revoke your Tier 2 sponosr licence again anyway. The level of power given to the State with no effective appeal rights encourages abusive behaviour and injustice in the system.
Tommy Robinson EDL founder failed to obtain US B1 visit visa
Infamous English Defence League (EDL) founder, Tommy Robinson, has failed to get a US visa following a US Congress invite to meet with Republican lawmakers. As recently reported by Workpermit.com, Robinson – real name Stephen Yaxley-Lennon – was rumoured to net a possible £1 million for his visit to the USA.
The Tommy Robinson proposed trip to the US Congress made big news around the World. There have been concerns that this would enable a far right extremist to raise substantial funds. It looks as if the trip will not be going ahead for the time being. The US B1/B2 visit visa has either been refused or delayed. It is perhaps worrying that Robinson has received support from people such as President Donald Trump and his former Chief Strategist Steve Bannon. Robinson was a member of the Neo-Fascist BNP that included numerous anti-semites and holocaust deniers amongst its ranks.
