Unfortunately, what has happened is not surprising. You cannot always trust those that are simultaneously working with the Home Office and apparently working for Migrants at the same time, to always put the interests of migrants first. In this regard, we have already mentioned serious and ongoing problems with UK Visa and Immigration at the Home Office, and how information from third parties is used.

Brexit if it does actually happen (or is delayed) is less than two months away. Many employers are starting to wonder what they will do if they are unable to recruit EU workers. The expensive, bureaucratic, and confusing Tier 2 Sponsor Licence and Tier 2 visa system is not fit for purpose in this situation.

The cost of recruitment for US visa border staff and others so far seems enormous.  Trump has claimed in the past how good he is at deal making.  This recruitment campaign seems to have wasted a great deal of money.  Perhaps it would have been better to have tried out more than one company to see what happens.  Just picking a very well known company to help does not always work.

Applying under the Tier 2 visa and Tier 2 sponsor licence scheme is expensive, complicated and difficult for both employers and employees. The Home Office guides are so lengthy and difficult to understand that some people must wonder if this has been done intentionally to put off people and so reduce immigration. The Government fees are quite enormous. As we have previously mentioned the total fees for a family of four for a large company is about £20,000.

The E2 visa may be the only US non-immigrant visa option in many cases. The L1 visa or H1B visa may not be possible. Like the L1 visa category there is no quota for the E2 visa. However, the E2 visa is only available for certain nationalities. Chinese and Indian nationals cannot apply unless they are the spouse or child of an E2 visa holder. It should be noted that to register the business as an E2 Treaty Investor business is quite a difficult and complicated process.

There seems to be increasing support for scrapping the Tier 2 visa cap. The cap makes it more difficult for employers with a Tier 2 sponsor licence from bringing in people resident outside the UK. Those migrants who are able to apply for a Tier 2 visa from within the UK do not come under the Tier 2 restricted CoS cap anyway. The Migration Advisory Committee report on 18 September 2018 suggested that the cap should be removed.
